Bad Faith
TLJ has particular experience and expertise in defending insurers in so-called “bad faith” lawsuits in which policyholders and others seek extracontractual and, sometimes, punitive or exemplary damages for alleged wrongful failures to defend or settle claims. Such cases involve volatile issues and the potential, in many cases, for substantial damages awards. Their successful resolution demands a combination of litigation and coverage expertise as well as a thorough grounding in the complex and rapidly evolving jurisprudence that exists in the bad faith area.
